Terms of Service

1. Acceptance of Terms

By accessing or using this mortgage CRM platform (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by your organization's administrator and powered by our SaaS platform.

2. Description of Service

The Service is a cloud-based customer relationship management platform designed for mortgage professionals. It includes lead management, pipeline tracking, automated communications, AI-powered mortgage analysis tools, and reporting features. The Service is provided on a subscription basis to organizations and their authorized users.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify your organization administrator immediately of any unauthorized use. Each user account is for a single individual and may not be shared. Your organization's administrator controls access levels, permissions, and user provisioning.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with all applicable federal and state regulations, including but not limited to the Truth in Lending Act (TILA), Real Estate Settlement Procedures Act (RESPA), Equal Credit Opportunity Act (ECOA), Fair Housing Act, Telephone Consumer Protection Act (TCPA), and the CAN-SPAM Act. You will not:

  • Use the Service to send unsolicited communications in violation of TCPA or DNC regulations
  • Upload or transmit malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to other accounts or systems
  • Use the Service to discriminate against any protected class in lending decisions
  • Misrepresent loan terms, rates, or estimates to consumers
  • Share login credentials or allow unauthorized third parties to access the Service

5. AI-Generated Content

The Service includes AI-powered features that generate mortgage analyses, estimates, and communications. All AI-generated content is for informational purposes only and does not constitute a loan commitment, pre-approval, or binding offer. Users are responsible for reviewing all AI-generated content before sending to consumers. Mortgage estimates and analyses are approximations and actual loan terms may vary based on underwriting, credit evaluation, and market conditions.

6. Data Ownership

Your organization retains ownership of all data entered into the Service, including lead information, communications, documents, and reports. We do not sell, share, or use your data for purposes other than providing and improving the Service. Upon termination, your organization may request a full export of its data within 30 days.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. Scheduled maintenance windows will be communicated in advance. We are not liable for downtime caused by factors beyond our control, including internet outages, third-party service failures, or force majeure events.

8. Subscription and Payment

Access to the Service requires an active subscription. Subscription terms, pricing, and billing cycles are established at the time of enrollment and may be updated with 30 days notice. Failure to maintain an active subscription may result in restricted access to the Service. Your organization administrator manages billing on behalf of all users.

Founding member customers who enroll under the launch offer receive the founding member workspace subscription price of $297/month locked for 12 months from the first paid invoice date, as long as the account remains active and in good standing. Founding members receive two onboarding calls in the first two weeks. LendAxiom may delay, reschedule, or block outbound SMS, iMessage, voice, or marketing email sends to enforce federal and state TCPA compliance rules, borrower opt-outs, DNC/TCPA signals, and organization policy.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by your organization for the Service in the 12 months preceding the claim. The Service does not provide legal, financial, or lending advice.

10. Termination

Either party may terminate the subscription with 30 days written notice. We may suspend or terminate access immediately if you violate these Terms or applicable law. Upon termination, your right to access the Service ceases, but your organization's data will be available for export for 30 days.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the state in which your organization is headquartered, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
